FIDOPH LENDING CORPORATION LIMITED END USER LICENSE AGREEMENT 
THIS END-USER LICENSE AGREEMENT (“License Agreement”) governs your use of the mobile banking application (“Application”) used to access the online lending service (the “Online Service”) of FIDOPH LENDING CORPORATION. This License Agreement is a legal agreement between you and FIDOPH LENDING CORPORATION (“Licensor”). By installing, copying or otherwise using the Application, you agree to be bound by the terms of this License Agreement. 
1. Grant of License The Licensor hereby grants you a non-exclusive, non-transferable, limited personal license to install and use the Application on your mobile device for your personal use and only to access the Online Service, subject to the terms of this License Agreement. Such installation must occur in the Republic of Philippines. You will not, and will not allow or cause any third party to: (a) decompile, reverse engineer, disassemble, attempt to derive the source code of, or modify or change the Application or its content, or use the Application to develop functionally similar applications; (b) copy the Application, except as expressly permitted by this Agreement; (c) sub-license, let, distribute, export, sell or resell the Application or otherwise transfer any rights thereto; (d) remove any proprietary or intellectual property rights notices or labels on the Application; or (e) otherwise use the Application or exercise any other right to the Application not expressly granted in this License Agreement. 
2. Ownership of Application The Licensor owns all rights, title and interest in and to the Application. No ownership, license or other right in or to the Application is granted to you except for the rights specifically set forth in this License Agreement. 
3. Termination This License Agreement is valid until terminated by you or the Licensor. Licensor may terminate the License Agreement at any time or for any reason. Your rights under this License Agreement will terminate immediately if you breach any of its terms and conditions. Upon termination of this License Agreement, you shall immediately discontinue use of the Application and delete all of its copies. Termination of the License Agreement shall not affect any other rights or remedies the Licensor may have under this License Agreement or under the laws of the Republic of the Philippines.
4. You understand and agree that the Application is provided on an “as is” basis, without warranty of any kind, and the Licensor hereby disclaims all warranties and conditions with respect to the Application, either express, implied or statutory, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement. The Licensor does not warrant against interference with your enjoyment of the Application, that the functions contained in, or services performed or provided by, the Application will meet your requirements, that the operation of the Application will be uninterrupted or error-free, or that defects in the Application will be corrected. 
5. Limitation of Liability To the maximum extent permitted by applicable law, the Licensor shall not be responsible for any loss, damage or injury or for any direct, indirect, special, incidental, exemplary, or consequential damages, including, but not limited to, lost profits, arising from or related to the application and/or the installation or maintenance thereof, failure of electronic or mechanical equipment, errors, configuration or incompatibility problems, problems or delays with intermediate computer or communications networks, or any other problems you experience due to causes beyond our control. 
6. Miscellaneous This License Agreement and its enforcement shall be governed by the laws of the Republic of Philippines. If either party waives any provision of this License Agreement, that waiver is not deemed to be a continuing waiver of the same or any other provision. If any provision of this License Agreement is found to be unenforceable for any reason, that provision will be deemed to be restated to reflect as nearly as possible the original intentions of the parties in accordance with applicable law. The remaining provisions of this License Agreement will not be affected thereby, and each of those provisions will be valid and enforceable to the full extent permitted by law. Any rights not expressly granted in this License Agreement are reserved by the Licensor. Section 2, 4, 5 and 6 will survive termination of this License Agreement. 

PRIVACY POLICY STATEMENT 
We respect your privacy and the confidentiality of your personal information and data. This Privacy Policy Statement outlines what personal information and data we collect and how we use and protect it. About Us FidoPh Lending Corporation (Fido) is an online lending company licensed by the Securities and Exchange Commission of the Philippines. We provide lending products and services accessible from our mobile application and website, http://www.fido.ph. General Agreement By using our mobile application and website, you (“User”) are agreeing and consenting to the following: (a) to our use of your personal information and data as described in this Privacy Policy Statement; (b) to provide us with true and correct personal information and data such that any misrepresentations or falsity therein will be considered by us as an act to defraud us and third parties relying thereon; (c) to authorize us to verify and investigate the personal information and data from the references you provided and other third party sources. For this purpose, you hereby waive your rights on the confidentiality of client information and expressly consent to the processing of any personal information and data relating to you that might be obtained from third parties, including government agencies, your employer, credit bureaus, business associates and other entities in accordance with Republic Act No. 10173 for the purpose of determining your eligibility for a loan you are applying for; and (d) to allow us to keep and own any of your personal information or data whether or not your credit score is determined or the loan is granted. Information We Collect We require personal information to operate and successfully provide our online lending products and services. The User provides us with personal information through our mobile application and website which falls under the following categories: (a) personal information provided by the User such as registration information, billing and collection information, and any information as a result of the User’s communication and commercial relationship with us, (b) personal information collected automatically through the use of our mobile application and website such as device information, log data and product usage data; and (c) personal information collected from third-party sources such as references, public databases (credit reference bureaus and identification registries), social network accounts with consent from the User, and third-party data providers. We take steps to ensure that third parties are legally and contractually bound to disclose personal information to us. How We Use the Personal Information and Data We use, collect, store, process and analyze the personal information and data that we collect from the User for the following purposes: (a) to process your transactions; (b) to improve our online lending products and services and your User experience; (c) for research and development; (d) for billing and collection; (e) to contact you regarding your account or send you system alert messages; (f) to give you information about our other online products and services; (g) to provide customer support; (h) to aid in credit analysis; (i) to verify your identity; (j) to meet legal requirements or respond to lawful requests by authorities; (k) to prosecute and defend our rights in a legal proceeding or enforce compliance with any agreement with us; (l) to give information to authorized third parties; and (m) for other related purposes in connection with our online lending products and services. Protecting Personal Information and Data We take appropriate technical and organizational measures to protect the personal information and data provided by our Users from loss, misuse, unauthorized access, disclosure, alteration, and destruction, taking into account the risks involved in the processing and the nature of the personal information and data. Any personal information or data transmitted through the mobile application is protected by secure socket layer (SSL) encryption. Your personal information and data can only be accessed by authorized third parties that needs access to such information and data to perform specified services. By agreeing to this Privacy Policy Statement, you agree that we may, as necessary and appropriate, transfer and disclose any of your personal information and data to the following third parties (who may also use, collect, store, process, transfer and disclose your personal information and data) for the purposes indicated herein and on a “need-to-know” basis: (a) any of our associates or affiliates including our directors, officers, employees and shareholders; (b) our vendors, suppliers, contractors, agents, service and payment providers which help us in our business operations; (c) persons acting in your behalf, payment recipients, beneficiaries, account nominees, intermediaries, correspondent and agent banks; (d) any third party to whom we provide introductions or referrals; (e) any party in connection with any business transfer, sale, merger or acquisition of Fido; (f) credit information bureaus; and (g) law enforcement agencies, courts, government officials or other third parties (i) when there is a formal request, subpoena, court order, or similar legal procedure, (ii) when we believe in good faith that disclosure is necessary to comply with the law, prevent physical harm or financial loss, or (iii) when there is a suspected illegal activity, (iv) to enforce compliance with any agreement with us, or (v) for any legally permissible purpose. We are constantly reviewing our information security practice to ensure that no one can gain unauthorized access to your personal information and data. User’s Data Protection Rights (a) You may access, correct, update or request deletion of your personal Information and data. We take reasonable steps to ensure that the data we collect is reliable for our intended use, accurate, complete, and up to date. You may contact info@fido.ph to access, correct, update, delete your personal information, or alter your data. We will consider your request in accordance with applicable laws. (b) You can object to processing of your personal information, ask us to restrict processing of your personal information, or request portability of your personal information. (c) You have the right to complain to the National Privacy Commission about our collection and use of your personal information. Retention of Personal Information and Data We retain personal information and data where we have an ongoing legitimate business or legal need to do so. Our retention periods will vary depending on the type of personal information or data involved, but, generally, we will refer to these criteria in order to determine retention period: Whether we have a legal or contractual need to retain the personal information or data. Whether the personal information or data is necessary to provide our services. If we have no ongoing legitimate business need to process your personal information or data, we will either delete or anonymize it or, if this is not possible (for example, because your personal information or data has been stored in backup archives), then we will securely store your personal information or data and isolate it from any further processing until deletion is possible. Changes to Privacy Policy Statement We may change this Privacy Policy Statement at any time and from time to time.
